This foundational principle, born from an era when only governments possessed the means to reach space, reflects the idealistic notion that space belongs to all humankind. However, it largely sidestepped the thorny issue of private ownership, a concept barely conceivable five decades ago when private entities lacked the financial muscle and technological prowess to dream of owning a piece of the moon or an asteroid. Conventional wisdom might suggest that property rights are top-down constructs, imposed by governments. Yet, history offers a compelling counter-narrative: rights often emerge organically from below, driven by labor and practical necessity, long before they receive official sanction.

Consider the settlement of the American West, a period famously dubbed the “Wild West.” As renowned economist Hernando de Soto detailed in “The Mystery of Capital,” pioneers and “squatters” laid claim to land through their labor—plowing fields, building homes, and establishing communities. They believed that their efforts, not arbitrary paper titles, conferred value and ownership. Governments only later formalized what these settlers had already established in practice. This spontaneous evolution, where societal conventions solidify into recognized rights, underscores a powerful principle: capitalism often develops as a spontaneous order from the grassroots.

This pattern isn't confined to distant history. More recent examples from former communist countries, such as China and Vietnam, echo de Soto's observations. In China, long before the official ban on private farming was lifted in 1982, peasants defiantly reintroduced private ownership, leading to remarkable agricultural booms and an end to recurring food shortages. Similarly, Vietnam's market-oriented reforms of 1986, which drastically reduced poverty, largely legalized developments already taking place at the grassroots level. Agricultural collectives and state-owned enterprises spontaneously ignored official regulations, entering into unauthorized private contracts in a phenomenon known as “Phá rào,” or “fence breaking.” Scholars argue that these bottom-up innovations, rather than top-down communist party directives, were the true catalysts for reform.

Charting a Course for Cosmic Ownership: The SpaceX Model

Applying these historical lessons to the vast expanse of space, Rainer Zitelmann, in his book “New Space Capitalism,” proposes a practical framework for establishing property rights. He argues that ownership should be granted to those who possess the financial resources and are willing to undertake the risks necessary to reach, develop, and productively utilize celestial bodies. This bold vision suggests a future where economic incentives drive humanity's greatest endeavors in space.

Imagine, for instance, if SpaceX successfully establishes a permanent settlement on Mars. Zitelmann posits that SpaceX should initially acquire ownership of a practical area—perhaps the size of Singapore—on the Red Planet. Given Mars's immense surface area, this would constitute a minuscule fraction (around 0.0005%) of the planet, leaving ample room for future competition. SpaceX could then finance its colossal transportation and development costs by placing this Martian land into a publicly traded Real Estate Investment Trust (REIT). The market, responding to supply and demand, would then determine its value, attracting investors eager to participate in this cosmic real estate boom.

The same principle could extend to asteroid mining. Ownership of smaller asteroids, rich in valuable resources like water or platinum, could be granted to the entities capable of extracting them. The most pragmatic approach might involve placing the entire asteroid into a publicly traded REIT, allowing investors to finance operations and shareholders to receive dividends from resource extraction. A functioning market for these shares could emerge even before the first dollar of revenue is earned.

Unlocking the Universe's Potential

While these remain thought experiments, they illustrate a compelling path forward for humanity to unlock the vast economic potential of space. By embracing a system where property rights evolve from entrepreneurial initiative and productive use—rather than waiting for cumbersome international treaties—we could catalyze an unprecedented era of commercial space development, settlement, and resource utilization.
