The foundational document governing humanity's activities beyond Earth, the United Nations' Outer Space Treaty of the late 1960s, is profoundly outmoded. It grants nations the prerogative to approve satellite projects registered under their flag, a provision that was never designed for the scale of today's satellite megaconstellations.
"The U.N. Treaty for Uses of Outer Space very well specifies that how many satellites are shot into space and how they are registered is a prerogative of the country in which they are registered," an anonymous source familiar with the UN Office of Outer Space Affairs (UNOOSA) told Space.com. While the treaty mandates that space exploration should benefit all countries, it offers no clear mechanism for recourse when consensus on these "benefits" cannot be reached. Efforts by states like Slovakia, in collaboration with the International Astronomical Union (IAU), to propose a "general prohibition on the use of space mirrors" or stronger oversight mechanisms within UN COPUOS face an uphill battle. UN institutions are notoriously slow, requiring unanimous consensus, which, as experts note, "hardly ever happens."
Moreover, the treaty's liability provisions, designed to cover physical damage, fall woefully short of addressing optical interference. Ruskin Hartley, CEO of DarkSky International, emphasizes that this framework doesn't extend to the significant damage caused by light pollution or visual obstruction to observatories.

The Catastrophic Impact on Earth and Beyond
The consequences of this unregulated industrialization of orbital environment are multifaceted and dire:
- Astronomical Blindness: A recent study by the European Southern Observatory warns that if all currently planned constellations materialize, the night sky's brightness could increase by up to 300 percent. This would effectively end ground-based astronomy as we know it, obscuring our ability to study distant galaxies, track potentially hazardous asteroids, and explore new frontiers of space mysteries.
- A "Saturn's Ring" of Debris and Light: Experts predict that the sheer number of orbiting data centers, vying for constant solar exposure, will coalesce into a dense, bright ring around Earth, reminiscent of Saturn's rings. Unilateral Decisions and Regulatory Failures
The U.S. plays a pivotal role in this crisis due to its regulatory stance. Robin J. Frank, an international space law expert and former NASA legal council, points out a pattern of "unilateral decisions" by the FCC, which prioritizes giving "U.S. industry a leg up," even when it contravenes international norms or lacks comprehensive environmental review. The U.S. National Environmental Policy Act (NEPA) contains an exemption for the satellite industry, a relic from the 1980s when launches were rare. This means neither the FCC nor satellite companies are legally obligated to prove their technologies won't harm the environment – a glaring "regulatory failure" in an age of unprecedented orbital deployments.
Legal challenges, such as DarkSky International's lawsuit against the FCC over SpaceX's licenses, have so far been unsuccessful. Without legislative reform or a significant shift in administrative policy, the current trajectory seems set.
